Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Audilyx (“the Service”), operated by Audilyx (“we”, “us”). By creating an account or using the Service, you agree to these Terms on behalf of your organization.

1. The Service

Audilyx provides AI-assisted quality auditing of voice call recordings, including transcription, automated scoring against configurable rubrics, analytics, and coaching workflows. Scores and insights are generated by automated systems and are intended to assist human quality reviewers, not replace their judgment.

2. Your account & organization

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. The first user to register an organization becomes its administrator and is responsible for managing members, roles, and access within that organization.

3. Your data & lawful use

You retain all rights to the call recordings, transcripts, and related data you upload (“Customer Data”). You represent and warrant that you have all necessary rights, consents, and legal basis to record calls and upload them for processing, including any consent required from the individuals on those calls under applicable law (including India’s Digital Personal Data Protection Act, 2023, and GDPR where relevant).

You must not upload data you are not authorized to process, and you must not use the Service for unlawful surveillance or any purpose prohibited by law.

4. Our use of your data

We process Customer Data solely to provide and improve the Service for you, as described in our Privacy Policy. We use third-party sub-processors (e.g. transcription and AI providers) to deliver the Service; these providers process data on our instructions.

5. Fees

Paid plans are billed in advance on a recurring basis. Usage-based charges (e.g. per-minute transcription/audit) may apply as described at sign-up. Fees are non-refundable except where required by law.

6. Availability & disclaimers

The Service is provided “as is” without warranties of any kind. AI-generated scores may contain errors; you are responsible for reviewing outputs before acting on them (e.g. in employee performance decisions). We do not guarantee uninterrupted or error-free operation.

7. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of the Service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. On termination you may request export or deletion of your Customer Data as described in the Privacy Policy.

9. Changes

We may update these Terms; we will notify organization administrators of material changes. Continued use after changes take effect constitutes acceptance.
